UNC getting in the way of Butch Davis going to FIU

I found this breaking news from Fox Sports to be pretty interesting.

A contract squabble with the University of North Carolina is keeping Butch Davis from becoming the next head coach at Florida International University, a source told FOXSports.com on Thursday night.

The dispute centers on almost $1.8 million that Davis is owed from the settlement he signed upon his dismissal as UNC’s head coach in July 2011. The source said that UNC doesn’t want to pay the money if Davis accepts another coaching position, which is a stumbling block that also complicated his hiring earlier this year by the Tampa Bay Buccaneers.

FIU is set to sign Davis to a multiyear contract averaging roughly $500,000 a season, the source said.

The Tampa Bay Times has reported that Davis is due annual payments of $590,000 from UNC every Jan. 15 between 2013 and 2015 as part of the severance deal. Davis was fired after a slew of NCAA infractions were committed during his four seasons (2007 to 2010) with the Tar Heels.

The ‘marriage’ of these jokers – Butch and UNC – is a gift that just keeps on giving. These two genuinely are/were perfect for each other. It is almost a shame that UNC’s pre-existing system of extreme academic corruption was in place to bring down old Butch; it might’ve been interesting/fun to watch Butch to continue down the path of doing it to himself for a while.

    Apparently the officials at UNC don’t understand the concept of hush money. 90k for two years is a small price to pay to Butch to keep his mouth shut about everything that went down. Of course, they probably think they are off the hook after the Martin “report.”

    So, I’m not at all familiar with the language in BMFD’s severance deal. But it seems pretty standard that these sorts of deals include language which voids the deal if the severed party accepts another position within the “same field”.

    Now, a disclaimer of sorts in that I’m prone to wild conspiracy theories and such. But, the fact that there has already been some wranglings b/w BMFD and U*NC over this makes me wonder if either a) this language in this deal is hazy, or b) BMFD is saying, gimme my money anyway or I’ll start talking…and U*NC is thus far calling his bluff.

    I still think Butch will only hurt himself (in more ways than one, actually) if he starts dishing dirt. But I sure hope he starts doing it anyway. Fingers crossed.

    I agree with Clarksa, I think the Holes believe they are all clear after the “exhaustive” review by Gov Martin. This is great. I hope they continue goad Butch until he starts singing. Maybe our new Governor and the cooperative legislature will show some interest- drag it out another 2 years. Once again their arrogance knows no bounds.

    Jim martin went to Sherwin Williams and bought a 1000 gallons of white paint to white wash the whole thing. Butch is a sleaze ball. I know it. You know it. The world knows it and even, yes, even the tar holes know it. The interview with WRAL put the cherry on top. I would not buy a used car from this shyster. Truly the gift that keeps on giving.

    Davis is screwed. He can bring down UNC but in doing so he brings down himself. If he really didn’t find out that UNC was dirty until after he took the job, he still looks bad cause he hired Black Santa and joined right in with the crooks and ran a dirty program.

    Well, it took a bit of doing. I had Butch’s contract saved and had to do an OCR conversion so that it could be copied and had to clean it up.

    Bottom line…..(ain’ no Lawyer, but read and administered a LOT of multi-million $$ contracts before retirment with the aid of the best corporate lawyers ($hark$) that $$ coud buy)

    UNC is on pretty firm ground…..as well they should be. I do NOT think that the BOT or the Outgoing Chancellor is going to let this “slip” by….not in today’s blinding (solar flare magnitude) LIGHTS of the Media.

    Here is the gory details…..read for yourself….but Butch, I believe, has to DEDUCT his NEW salary from any amount OWED…..GO HEELS ON THIS ONE!

    XI. TERMINATION BY UNIVERSITY WITHOUT CAUSE; LIOUIDA TED DAMAGES
    (a) Following consultation with the Athletic Director, this Agreement may be terminated unilaterally by the Chancellor at any time upon written notice to COACH, in the absence of Cause (as “Cause” is defined in Section IX of this Agreement) .
    (b) In the event this Agreement is terminated pursuant to Section XI(a) above, UNIVERSITY shall pay COACH liquidated damages in lieu of any and all other legal remedies or equitable relief in an amount equal to:
    (1) the sum of (x) $275,000.00 plus COACH’s then current annual salary (as determined pursuant to Section III(a) of this Agreement), multiplied by (y) the number of full and partial contract years remaining under this Agreement, plus
    (2) Any amounts then accrued in the deferred compensation or similar type of retention arrangement provided for in Section XIV, plus
    (3) Any supplemental compensation payments due COACH pursuant to Section XV of this Agreement with respect to the remainder of the then current contract year; provided, however, that the liquidated damages payable pursuant to this Section XI(b) shall be subject to offset, as set forth in Section XI(c) below.
    (c) Payment of the amount determined pursuant to Section XI(b)(l) shall occur over the remaining term of the Agreement as follows: (1) on the effective date after termination without Cause, payment shall be made of amounts due with respect to the remainder of that contract year; and (2) payments due hereunder with respect to each subsequent contract year shall be made on the last day (January 15) of such subsequent contract year, until all amounts due have been paid in full. Payment of the amount described in Section XI(b )(2) shall be made as provided for in Section XIV. Payment of the amount described in Section XI(b )(3) shall be made when due under Section XV. COACH acknowledges and agrees that the amount of liquidated damages due pursuant to this Section XI shall be reduced by any compensation received by COACH during the time period remaining under this Agreement for services provided by COACH in a coaching position for any college or professional football program. COACH shall account to ‘ UNIVERSITY for any such compensation by providing a statement in writing ten (l0) business days prior to each scheduled payment date setting forth the amoUnt of such compensation earned by COACH (x) during the preceding contract year, and (y) in total since the effective date of termination. Amounts for services shall be deemed “earned” at the time the services are provided, regardless of when actual payment for such services is received. Except as specifically provided above in this Section XI, the UNIVERSITY in such case shall not be liable to COACH for compensation (including supplemental compensation provided for in Section XV), for benefits with respect to periods after the effective date of termination, or for any collateral business opportunities or other benefits or activities entered into pursuant to Section VI of this Agreement which may be related to his position as Head Football Coach.
    (d) The parties have bargained for and agreed to this liquidated damages provision, giving consideration to the following: (1) this is an Agreement for personal services; and (2) the parties recognize that a termination of this Agreement by UNIVERSITY prior to its natural expiration could cause COACH to lose benefits, compensation, and/or outside compensation relating to his employment at UNIVERSITY, which damages are difficult to determine with certainty. Therefore, the parties have agreed upon this liquidated damages provision and further agree that the liquidated damages provided for herein are reasonable in amount and not a penalty.
    (e) Termination of this Agreement upon the death or disability of COACH, as provided in Section X of this Agreement, shall not give rise to a right to liquidated damages pursuant to this Section XI.

    Yep. If that happens, he’ll never coach again at a major university, and would be lucky to get any job.

    Ask Bruce Pearl how his job market is these days, and he ‘only’ ratted out another school, not his own.

    I don’t really see this from Butch’s point of view. I thought that he took his position with Tampa Bay because it wasn’t technically “coaching” and it was a consultant or something. It was reported earlier this year that he got $590,000 / year from u*nc unless he took another coaching job. Why would anybody not ride that period of time out before they take a new coaching position? That is what Gott did with Alabama. Butch ha to be doing this because he has an axe to grind with u*nc and he is trying to play hardball. By not following the official contract stipulations but still wanting the payment he is basically telling the world it is hush money, and daring them not to pay regardless of the contract agreement.
