Are they really going to get away with this?

Davis told reporters last week that the university reviewed the records in the fall of 2010. That’s true, but the university never made copies.

“He didn’t give us the records,” said Nancy Davis. “We hired outside legal counsel to take a look at them, but he retained the records, and he has them now.”

Nancy Davis said she did not know what the university’s counsel reported back regarding Butch Davis’s personal cell phone records, but it so far has not been tied to any NCAA violation. Thorp said Thursday that there are no new allegations surrounding the cell phone or any other information requested by reporters.

First, UNC didn’t review McAdoo’s paper for plagiarism prior to arguing to the NCAA that the paper was really McAdoo’s work. Now, UNC admits that nobody from the administration or compliance department reviewed Butch’s 216 phone records. They hired “outside counsel” to handle the review. Even worse is that UNC didn’t retain a copy of these records as part of the investigation.

Certainly that didn’t happen on purpose.

Is it standard for phone records to be reviewed by outside legal counsel and not representatives of the university itself in this sort of investigation? If UNC didn’t review McAdoo’s paper and they didn’t review Butch’s cell phone, then what exactly have they reviewed? Was the academic work in question with the cleared players read by UNC’s administration? Were phone records ever reviewed by UNC’s compliance department?

It makes you wonder if the NCAA ever received the 216 phone records or even asked to review them. Instead of the public getting answers in today’s press conference, the limited information we have to deal with is only creating more questions, more reasons to not trust UNC’s leadership, and more reasons for there to be an independent investigation.

Also, it appears that the stories of Butch and UNC are conflicting.

Davis at the ACC Kickoff said:

Davis said he will release his personal cell phone records to the public “very soon,” but did not specify when. Davis said the school has had the records in its possession for months, which he indicated is a sign that there are no significant concerns with them.

UNC spokesman Nancy Davis said today:

“He didn’t give us the records,” said Nancy Davis. “We hired outside legal counsel to take a look at them, but he retained the records, and he has them now.”

So which is it? Was Butch misleading the media and public with his portrayal of the “review” of his 216 records or is Nancy Davis correct that UNC never had the records in the 1st place?

Certainly, this seems like a point needing clarification.

Why might Butch and UNC hope to avoid the 216 records being released? Because of information like this potentially being found maybe?

Okay, I’ll try and make this as easy to follow as possible…

In looking at the various contacts that Blake had with Marvin Austin, a few numbers/trends started to show up.
One was that Todd Amis, one of Marvin’s old (assistant) high school coaches, would converse with Blake around the same time. Amis, of course, has since been proven to have paid for some of Marvin’s travel expenses — and then been reimbursed by Wichard. He was a go-between for money; there’s not much way around that.

However, another Washington, DC number also started to show up a lot. Blake spoke with this number 15 times in 2009, and then 15 more times in 2010. The kicker is that lots of times these conversations were immediately before or after those with Todd Amis, and a phone with Gary Wichard was sure to be nearby, as well.

The address that Waffle posted is the one that is associated with the owner of the number. (the owner of the number is not Adjelegan Lassey, FWIW — but the non-profit organization that someone else listed is, however, associated with the address)

Furthermore, the address associated with this “other” Washington phone… Marvin’s house in D.C. …. and Marvin’s old high school…. are all within five miles of one another.

To help drive the connection home, here are five different dates from 2009: (there’s much more in 2010, by the way — these are the only ones I’ve detailed so far)

“Chan” is associated with an address that houses a non-profit organization.
This location is within five miles of Marvin’s D.C. house, and Marvin’s old high school.

Another poster made these comments:

Someone at that non-profit shared a group cell phone with Marvin Austin and was in constant talks with Blake and Amis at the same time. Person “X” cell phone was 1-single digit different than Austin’s. Person “X” was another middle man funnelling money it appears and either owns said property or works at “Africa for All Seasons” a non-descript non-profit that was just cited for tax evasion. Lots of smoke that this place was a fraud. You cant make this stuff up. Very interesting.

Now, maybe the Packpride posters have it all wrong, there is nothing to these posts, and/or the information is inaccurate. However, message board posters broke the plagiarism story, so just maybe these guys are on to something?

    Guys, the non profit is not necessarily involved in tax evasion. A ton of non profits just got their exempt status jerked because of failure to file the 990 which is NOT a tax return, but an information return on the organization. Before one of you whiz kids says it is, a 990T is the tax return.

    I just pulled the same info up on Guidestar.

    Maybe it was the source to help McAdoo write his paper…

    David Glenn says that both Thorp and the BOT are just ignorant of how college athletic programs work and that is why they pulled the trigger now with such poor timing. All I can say is that of all the crazy spin put out to date that one wins the prize. They all follow the two main programs very closely and had to have known, and been instructed by Baddour that they were making a crazy decision. So call it like it is. Either they just didn’t give a damn or they heard the next shoe dropping and decided to pull the emergency eject cord. Come on Dave, Thorp is really so busy with important University business that he is not following what is happening with the football program? What with the effort underway for Butch to bring big time football to UNC going on including the $70 million improvements to Kenan. I am calling you out on that b.s. dude.

There’s a lot of things I don’t need to know, don’t know and they’ve handled everything.”

    Talk about an understatement…nobody knows anything (or should I say, nobody knows nothing) and nobody cares to know anything. As long as you don’t know something, you can’t possibly be held accountable for it, can you?

    I mean what the H3LL have they been doing for the last YEAR?
    I guess the internal investigation was completed by the infamous Honor Court?

    My guess is, they have been sitting on their A$$, waiting for this storm to pass.

    Our fellow in DC was party to a lawsuit on behalf of a handicapped child. The suit was against the District of Columbia and Michelle Rhee and Lassey was one of the plaintiffs.

    Guess what problem Rhee is having now.. Cheating and test score irregularities in the DC school system. No connection though cause she was the DC school system chancellor. She’s been canned, but her name keeps coming up in relation to the Atlanta school system problem similarities..

    That’s a shame considering Thorp is charged with finding a new football coach. Hope he doesn’t do something silly and accidentally hire a badminton coach. With as much ignorance that’s present at UNC, I wonder how anybody does anything over there.

    Pittman would logically have been the guy given the move up to assistant head last week. This tells me Thorpe knows pittman’s connection to Blake. The media storm of that move would have been tremendous assuming folks cared enough to write it.

    Highstick:

    Let’s think hypothetically for a second given your knowledge of accounting issues.

    I’m a major donor to a school and its athletic program. Or in the alternative, I’m an agent wanting to influence a current college athlete/recruit so one day he might work with me when he goes pro. I have more money than I have sense. I want to funnel foldin’ money to some young men at a particular university, but I’m not sure how I would do that in a way that would possibly cover up a paper trail.

    SOmeone approaches me and says there’s a nonprofit agency willing to accept that money as a donation and then funnel it to this recruit/player/team.

    I write a fat check to this nonprofit agency knowing that the money won’t be going to a third world country to buy shoes and rice bowls for the less fortunate. Regardless, I put this donation down on my tax returns as a charitable donation. I receive a tax benefit therefrom.

    Instead of rice bowls and shoes, the money gets used, as explained to me, to buy overpriced pastries and trips to here, there, everywhere for college players/recruits.

    Being that I knowingly received an erroneous tax benefit from a knowingly misrepresented tax return… is that not tax evasion?

    I shudder to think what the BoG would have done if all this crap happened at NC State. It’s sickening to think how much they get away with.

    Any contact by a UNC-CH official or employee to the 216 phone would prove that some portion of that phone’s use was for official state business and should be in the public record.

    I believe Blake’s phone records showed calls to the 216 number. And Baddour’s work phone also made calls to that number.

    This much is already proven. There’s enough evidence to make the case that Butch used that phone for work purposes. Therefore, those records should be a matter of state record and open to scrutiny.

    If only someone would pursue them.

    Facebook Page: “I Support Butch Davis” now selling “I Don’t Support Thorpe” tee shirts. Ha!

    Despite the media saying UNC fans upset, that is not true with most the UNC fans/alum I know, they are happy that Davis was let go. And most estactic that Baddour stepping down. Most know someone on staff at UNC and most knew Blake and the recruiting tactics were bad news, so they know Davis may have distanced himself from it, but he was aware. Many suspect coaches from other schools may have reported UNC to the NCAA, something we will never know for sure. Many think Davis is the reason Woody Durham left when he did.

    GAWolf…

    It would be considered fraud if the deduction you took reduced you taxble income by more than 25%. I think that is the percentage. If that is the case then there is no statue of limitations for the IRS to look at the return. It is always open to audit.

    Whether it is tax evasion it depends on what they can prove. I would think so if you knowingly made the contribution under the guise that the non-profit was really a way to funnel money college athletes for special favors.
